This site,https://digitalhorizon.ph/shop/ is owned and operated by Digital Horizon. The following Terms and Conditions constitute an agreement between you and Digital Horizon. 

Please read this Terms and Conditions carefully as the same contains important information that you need to consider before accessing our site. 

The following Terms and conditions constitute an agreement between you and Digital Horizon. This Agreement, comprising the Terms of Service and Business Policies delineates the rights and obligation of Digital Horizon and the Customer. By agreeing to these terms, the Customer consents to utilize Digital Horizon’s products and services with a subscription.

INTELLECTUAL PROPERTY RIGHTS 

Everything that appears on this Site, including instances, pictures, images, and general web design concepts, is reserved belonging to Digital Horizon. Digital Horizon owns the rights to all contents posted on this site, including articles, video clips, and other informative material, regardless of format. You are not permitted to duplicate, send out, share, monetarily misuse, or otherwise transfer any copyrighted content prior authority. 

ACCESSING AND PROVIDING PERSONAL INFORMATION VIA OUR WEBSITE 

  • When you submit information via a web form or email, you are engaging in electronic communication with us. Additionally, when you visit our websites and sign up for or subscribe to our services, we collect information during your visit. The nature of the information collected, its retention duration and methods, usage, and disclosure are all governed by our Privacy Policy. 
  • As part of delivering our services to you, we may need to communicate certain messages, such as administrative notices, via email, instant message, or other channels. Prior to subscribing, please inform us if you wish to schedule an appointment. If you have enrolled or subscribed to any of our communications, our service updates and administrative notifications are integral components of the Services themselves. You have the option to opt out of receiving these communications by unsubscribing or contacting us at admin@digitalhorizon.ph. 
  • By accepting our services, you acknowledge that all agreements, notices, authorizations, disclosures, and other communications we furnish to you electronically, along with any

acceptances, agreements, consents, or authorizations you provide to us electronically, fulfill any and all legal requirements for written communication. 

FREE TRIAL 

  • This agreement shall extend to instances where a customer opts for a Free Trial within 30 days. Some functionalities may be subject to restrictions based on technological capabilities and policy limitations. 
  • In the event that the customer does not proceed with a subscription following the conclusion of the free trial period, their account will be subject to automatic deletion. ● Should the customer opt for a one-year subscription, they will be granted a grace period of 60 days following the expiration of their subscription term. During this grace period, they will have the opportunity to renew their subscription. However, if they fail to do so within the specified timeframe, all data associated with their account will be permanently deleted. 

SERVICE 

  • Digital Horizon offers innovative features to its diverse range of customers and implements regular or sporadic updates to incorporate cutting-edge techniques and concepts into the service. 
  • Digital Horizon encompasses the implementation, customization, maintenance, and support of ERP software tailored to meet the specific needs of your enterprise. This includes but is not limited to modules for finance, human resources, supply chain management, and customer relationship management. 

PAYMENT 

  • Payment: The Customer shall remit payment for the Digital Horizon on a monthly basis. ● Service Period: Upon the expiration of the subscription, access will be terminated; however, the account will not be immediately deleted. If the account remains inactive for 60 days following the termination, it will then be permanently deleted. 
  • Payment Method: Digital Horizon offers two payment methods: debit/credit card payments through Stripe and manual payment options. 
  • Tax included: Because the Customer is liable for all relevant taxes as determined by their regulatory authorities, payments for the Digital Horizon Service must include the necessary taxes. 

TERMINATION 

  • In the event that the customer is unable to fulfill payment obligations or renew the contract upon its expiration, termination will ensue. 
  • Cancellation by Digital Horizon: Digital Horizon reserves the right to terminate services at any time, particularly in the event of a breach of agreement by the customer. In such instances, the customer will receive notification of cancellation at least 30 days prior to the effective date, delivered via email or through designated content pages.
  • Cancellation by Customer: The customer retains the option to terminate the service at their discretion. 
  • Disposition of data following cancellation: Digital Horizon bears no responsibility for the storage of customer data upon cancellation or termination of services. 

EXEMPTION AND RESTRICTIONS 

  • Limit for compensation amount: Even if Digital Horizon caused any harm and the Customer claims that Digital Horizon is accountable for the occurrence, Digital Horizon will not give compensation in excess of the amount paid by the Customer 12 months previous to the event. 
  • When the Customer subscribes to the Service, he or she will use it based on his or her own assessment of its appropriateness and utility.Digital Horizon does not claim that the Service is suitable for all locations or countries where a Customer resides. 

MISCELLANEOUS 

Applicable Law & Dispute Resolution: 

1.1 This contract shall be governed by and interpreted in accordance with the laws of the Republic of the Philippines. 

1.2 Any disputes arising out of or in connection with this contract shall be finally settled by arbitration in accordance with the laws of the Philippines. 

Consent: By subscribing to the Service, the Customer agrees to all documents that constitute the Agreement, including the Terms of Service, Business Regulations, and Service Level Agreement (SLA). 

Interpretation of Contradicting Terms: In the event of a discrepancy between the documents that constitute the Agreement and the Service Website, the order of priority shall be as follows:

We strive for your satisfaction with our services and hope that you encounter no issues. You also retain the right to lodge complaints with us via the aforementioned email address or with the National Privacy Commission in case of any issues.
